Judge Trying To Block AZ’s Prop. 200. [Bryanna

Less than thirty days after receiving 56% of the vote
and within hours of a Gubernatorial proclamation as law,
Prop 200 has been (temporarily) thwarted by
MALDEF and U.S. District
Court Judge David C. Bury, a Bush II appointment.
Prop 200 is an Arizona ballot measure that would require
proof of citizenship for all voters and limit public
welfare benefits for non-citizens.
Sounds simple enough. But MALDEF and its friendly judge
disagree.
“Attorneys
for MALDEF argued that the denial of welfare benefits
would "jeopardize the health and well being of families
and children” and that the proof of citizenship
provision would "disenfranchise thousands of voters."

Judge Bury
was apparently more worried about “undocumented
aliens” than about the citizens of his state:
“In his
order, Judge Bury, nominated by President Bush in 2001,
said the proposition would have ‘a dramatic chilling
effect upon undocumented aliens who would otherwise be
eligible for public benefits under federal law,’ adding
that state officials have acknowledged there is no
‘tangible harm’ to halting the law for now.”
