From the NYT:

Appeals Court Deals Blow to Obama’s Immigration Plans By MICHAEL D. SHEAR and JULIA PRESTON NOV. 9, 2015

WASHINGTON — A federal appeals court said Monday that President Obama could not move forward with his plans to overhaul immigration rules by providing up to five million people with work permits and protection from deportation.

I’ve said this a million times, but there is a fundamental difference between the omission of “prosecutorial discretion” and the commission of handing out five million Get Out of Jail, Free cards. Prosecutors get to overlook cases they don’t have time for, but “prosecutorial discretion” doesn’t extend to printing up millions of work permits.

Now we’ll see if the Supreme Court gets it.
